Historically, the legal landscape surrounding protests in NSW has allowed demonstrators to gather even when a protest was officially prohibited, as long as they adhered to specific guidelines under the Summary Offences Act.
Previously, if a court deemed a protest unlawful but individuals showed up anyway, they would not face charges unless they were actively obstructing traffic, ignoring police orders to disperse, or causing harm. This leniency has now shifted; mere attendance at a banned protest could lead to charges of contempt of court if demonstrators are aware of the court's ruling, or they may be accused of joining an unlawful assembly.

Since its introduction in 1979, the form 1 process allows protest organizers to notify police in advance of their intention to hold a public assembly. If law enforcement objects, the final decision rests with the Supreme Court, which can either authorize or prohibit the protest.
Sarah Schwartz, a legal director at the Human Rights Law Centre, emphasized that the new ruling could discourage individuals from utilizing this system. "It really means that people are now going to have to make a choice," she explained. "I would say it’s kind of the opposite of having a system that facilitates peaceful protest because it means that there’s an incentive now for people not to make an application under this system." An organizer echoed this sentiment, stating, "Why would I now risk turning a lawful right to assemble into an unlawful one?"

Assistant Commissioner Peter McKenna stated, "I think, by and large, people want to work with the police, and they want to get the outcome they want. They don’t want the conflict; we don’t want the conflict, and we want to make sure people are safe." This perspective suggests a continued commitment to facilitating peaceful assemblies, regardless of the new legal landscape.
